Your privacy is important to us. This Privacy Policy ("Policy") describes how TalentFlux-AI collects, uses, and protects your personal information when you use our AI-powered hiring and job search platform.

This Policy applies when you use our services. If you are a job seeker or employer using the TalentFlux-AI platform, this policy explains how we handle your personal information.

What Information Do We Collect?

Information You Provide to Us

Account Information. To create an account for the Services or to enable certain features, we may require that you provide us with information for your account such as name, email, profile picture, password, and authentication credentials.

Payment Information. We use PayPal to process payments. We do not store your credit card or bank account details. All payment transactions are processed directly and securely by PayPal according to their privacy policy.

Job-Related Data. When using our Services, you may submit or upload your resume, job history, skills, preferences, and other professional information. This data is used to provide our AI-powered matching and recommendation services.

Business Contact Information. If you are a business representative, we collect your information in connection with the performance of the agreement or potential agreement with us. This may include your name, email address, phone number, job title, and company information.

Mandatory Data Provision

Certain Personal Information we request is mandatory for the purposes of: Verifying user identity, creating and maintaining accounts, and providing core features of the Services.

If you refuse to provide mandatory information, we may not be able to provide all or part of the Services, including but not limited to account creation, use of AI features, or recruitment connections.

Legal Basis for Data Processing

The collection and processing of your Personal Information is carried out based on one or more of the following legal grounds:

Data Processing Timeline

Processing of your Personal Information begins when you: Agree to this Privacy Policy; or create an account and/or use our Services.

Processing will end when: You validly withdraw consent; you request account and personal data deletion; or data is deleted according to applicable law.

Cookies and Tokens

We use Cookies to store Access Tokens and Refresh Tokens for security purposes and to maintain your login session. We do not use Cookies for tracking or advertising purposes.

Our Service may contain links to other websites not operated by us. We practice no control over and assume no responsibility for the content or privacy practices of any third-party sites. We encourage you to review the privacy policy of every site you visit.

Children's Privacy

Our Service does not address and is not intended for anyone under the age of 16. We do not knowingly collect personal information from children under 16. If you believe we have collected information from children under 16, please contact us to remove that information.

Rights and Obligations under Vietnamese Law

In addition to the rights stated in this Policy, you have the full rights and obligations of a Data Subject as stipulated in Decree 13/2023/ND-CP on Personal Data Protection.

Potential Risks and Unintended Consequences

Although we strive to apply appropriate technical and organizational measures to protect your Personal Information, data processing on the Internet and information technology systems always carries certain inherent risks.

Potential consequences or unintended harm may include, but are not limited to:

Unintended data disclosure due to user self-sharing of information, granting inappropriate access permissions, or misconfiguring privacy settings;

Third-party data misuse after you grant access or after data is shared according to Service features;

Inaccurate or outdated information due to your failure to update timely, leading to unsuitable analysis results, recommendations, or recruitment connections;

Errors in analysis results or AI-generated suggestions arising from input data, algorithmic models, or technical limitations of the technology;

Technical incidents, system errors, cyberattacks, or force majeure events beyond our reasonable control.

To the extent permitted by law, TalentFlux-AI is not liable for damages arising from the risks stated above, except where damages arise from our intentional fault or serious breach of security obligations.

We may update this Policy to reflect changes to our services or legal requirements. The latest version will always be posted on our website.

Terms of Use

This Customer Terms of Service is entered into by and between TalentFlux-AI and the entity or person accessing our Services. By accessing or using TalentFlux-AI, you agree to be bound by these Terms of Use.

Definitions

"Agreement" means these Customer Terms of Service and any Order Forms, attachments, or linked policies.

"Services" means the AI-powered hiring and job search platform and related services that TalentFlux-AI provides to you.

"Customer Data" means any data in electronic form that you or your authorized users make available through the Platform.

"User" means employees, agents, consultants, or other representatives authorized by you to access or use the Services.

"Platform" means the TalentFlux-AI software platform and associated infrastructure.

The Services

Service Provision

Subject to your compliance with these Terms, TalentFlux-AI grants you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Services during the subscription term.

TalentFlux-AI Ownership

TalentFlux-AI retains all rights, title, and interest in and to the Services, Platform, and all related technology, including all intellectual property rights. You acquire no ownership rights in the Services.

AI Features

Our Services include AI-powered features for candidate matching, job recommendations, and automated screening. These features are designed to assist, not replace, human judgment in hiring decisions.

Customer Data

Ownership

As between you and TalentFlux-AI, you retain all rights, title, and interest in and to your Customer Data. You grant TalentFlux-AI a limited license to use Customer Data solely to provide the Services.

Security

We implement administrative, technical, and physical safeguards designed to protect Customer Data. However, you are responsible for maintaining the security of your account credentials and for all activities under your account.

Restrictions and Responsibilities

Illegal Purposes. Use the Services for any illegal purpose or in violation of any applicable laws

Unauthorized Access. Attempt to gain unauthorized access to the Services or related systems

Interference. Interfere with or disrupt the integrity or performance of the Services

Reverse Engineering. Reverse engineer, decompile, or disassemble any part of the Services
-
Malicious Code. Use the Services to transmit any viruses, malware, or harmful code
-
Rights Violation. Violate any third-party rights, including intellectual property or privacy rights

Fees and Payment Terms

You agree to pay all fees as specified in your subscription plan. All fees are non-refundable except as required by law. We may change our fees upon 30 days' notice.

Term and Termination

This Agreement begins on the date you first access the Services and continues until terminated. Either party may terminate this Agreement for material breach if the breaching party fails to cure within 30 days of written notice.

Upon termination, your right to access the Services will immediately cease. We will make Customer Data available for download for a period of 30 days following termination.

Limitation of Liability

To the maximum extent permitted by law, TalentFlux-AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

AI System Limitations

The analysis, assessments, rankings, suggestions, or recommendations generated by TalentFlux-AI's AI system are for reference and decision support purposes only.

TalentFlux-AI does not guarantee that:

Results generated by AI are completely accurate, comprehensive, or suitable for all purposes;

AI suggestions will lead to optimal recruitment, personnel management, or business decisions.

Users are solely responsible for all decisions made based on results provided by the AI system.

User Responsibility

TalentFlux-AI is not responsible for:

Job posting content, candidate profiles, or HR information posted by users;
-
Contact behaviors, exchanges, interviews, agreements, or arrangements between parties;
-
Any disputes, complaints, or damages arising between employers, job seekers, or other related parties.

All disputes arising between parties using the Services shall be resolved by the parties themselves, without involving TalentFlux-AI's liability.

Service Interruption and Modification

TalentFlux-AI reserves the right to suspend, interrupt, or modify all or part of the Services when necessary for system maintenance, upgrades, incident resolution, or as required by competent authorities.

TalentFlux-AI is not liable for any damages arising from service interruption, delays, data loss, or inability to access Services in the aforementioned cases.

Force Majeure

TalentFlux-AI is not liable for failure to perform or delay in performing obligations due to force majeure events, including but not limited to: natural disasters, fires, pandemics, wars, riots, telecommunications infrastructure failures, large-scale cyberattacks, or decisions by competent government authorities.

Indemnification

Users agree to indemnify and hold TalentFlux-AI harmless from any claims, damages, liabilities, costs, or losses arising from:

User's violation of these Terms;

User's violation of applicable law;

Use of Services causing damage to third parties.

Terms Modification

TalentFlux-AI reserves the right to update or modify these Terms at any time. Continued use of the Services after Terms are updated constitutes your acceptance of such changes.

Data Processing Agreement

This Data Processing Agreement ("DPA") forms an integral part of the TalentFlux-AI Terms of Service between the party named as Customer and TalentFlux-AI, reflecting the parties' agreement with regard to the processing of personal data.

Definitions and Interpretation

Definitions

Unless otherwise defined herein, capitalized terms shall have the following meanings:

"Company Personal Data" means any Personal Data processed by TalentFlux-AI on behalf of the Customer pursuant to the Agreement.

"Data Protection Laws" means GDPR, applicable U.S. federal and state privacy laws, and any other applicable data protection or privacy laws.

"GDPR" means EU General Data Protection Regulation 2016/679.
-
"Subprocessor" means any entity appointed by TalentFlux-AI to process Personal Data on behalf of the Customer.
-
"Personal Data", "Data Subject", "Processing", and "Controller" shall have the same meaning as in the GDPR.

Data Processing

Processing Obligations

TalentFlux-AI shall process Personal Data only on documented instructions from the Customer, unless required to do so by applicable law. We shall immediately inform the Customer if we believe an instruction violates Data Protection Laws.

Subprocessing

The Customer grants general authorization to TalentFlux-AI to engage subprocessors to provide parts of the Services. We maintain a current list of subprocessors and will notify the Customer of any intended changes to allow the Customer to object.

Data Subject Rights

TalentFlux-AI shall assist the Customer in responding to requests from data subjects to exercise their rights under Data Protection Laws, including rights of access, correction, deletion, and data portability.

Personal Data Breach

TalentFlux-AI shall notify the Customer without undue delay upon becoming aware of a Personal Data Breach affecting Company Personal Data, and shall provide reasonable assistance to the Customer in investigating and mitigating the breach.
